CLASS ACTION DIVISION
Article 1050.2 of the Code of Civil Procedure provides for the creation of a central registry of class actions instituted in Quebec. This registry will begin operating on January 1, 2009.
The Class Action Registry will provide an overview of the class actions instituted in Quebec since January 1, 2009. It will permit both attorneys and the general public to obtain information on every class action instituted in Quebec as of January 1, 2009. The Class Action Registry will be joined to the National Class Action Database of the Canadian Bar Association. As such, any proceeding entered in the Class Action Registry will be automatically registered in the National Class Action Database.
Starting January 1, 2009, plaintiffs' attorneys must comply with the following procedure as part of the class action case management process:
The filing of a motion for authorization to institute a class action or of a motion to institute proceedings in a class action, as well as any amendment thereto, must be entered in the Class Action Registry as soon as possible through the following website:
Registre des recours collectifs
In the section "accès aux avocats", you will be able to register the proceeding after identifying yourself using your Quebec Bar access code.
Please note that all proceedings must be in PDF format.
