NOTICE TO THE MEMBERS OF THE BAR
SUPERIOR COURT - DIVISION OF MONTREAL
REQUEST FOR PSYCHOSOCIAL EVALUATIONS

Orders for a psychosocial evaluation are issued with the consent of the parties after the judge has ascertained that it is appropriate to do so ( rule 33). |

The order is issued from the bench, in the presence of the parties. The judge may issue the reasons for his decision later. The Clerk of the Court transmits all relevant documents to the Service d'expertise.

At the interlocutory or provisional stage, the judge ordering the evaluation, if he chooses not to remain seized of the file, can request that the report be forwarded to the Chief Justice or to a judge designated by the latter. In every other case, the judge ordering the evaluation remains seized of the file. |

The request for evaluation must be filed with a copy of Form V duly completed regarding consent to an evaluation (Rules of Procedure of the Superior court in Family Matters).

In Form VI to order a psychosocial evaluation, the judge must indicate the latest date at which the report must be submitted as well as the name of the judge to which it should be forwarded (the Chief Justice, a judge designated by him or the undersigned himself).
