NOTICE TO THE MEMBERS OF THE BAR

SUPERIOR COURT - DIVISION OF MONTREAL

EXAMINATION OUT OF COURT - OBJECTIONS

When parties require a hearing before a judge in order to adjudicate objections raised during an examination out of court at the Court House ( in Montréal) and the amount of time required to adjudicate the objections is less than two hours, they shall attend before the Master of the Rolls who will indicate to them which judge is available to hear them;

If the parties are not in the midst of the examination and the amount of time required to adjudicate the objections is less than two hours, they contact the office of the Master of the Rolls (393-2322) and inquire about the availability of a judge to hear them;

In every case where the amount of time required to adjudicate objections is over two hours, the parties must, preferably in a joint document, set out the objections, classify them by subject, and indicate the time required for each subject. After having filed this document with the Office of the Master of the Rolls, the parties must contact the latter in order to fix a date for hearing in Room 2.08. A notice of presentation to this effect must be filed and served.
